الرقابة على الصفقات العمومية في ظل المرسوم الرئاسي 15/247

Abstract

تهدف هذه الدراسة إلى التعريف بمختلف آليات الرقابة على الصفقات العمومية الرقابة الداخليـــــــــــــــــــــة (لجنة دائمة لفتح الأظرفة وتقييم العروض)، والرقابة الخارجية (لجان الصفقات)، هذه الرقابـــــــــــــــــــة ذات أهمية بالغة طالما أنها تتم وفقا للقانون، واحترام شروط المنافسة وتكافؤ الفرص في الوصول إلـــــــــــــــــــــــــى الطلبات العمومية، وبالتالي احترام تنظيم الصفقات العمومية. ولقد تم الاعتماد على المنهج الوصفـــــــــــي التحليلي لملائمته للموضوع، خاصة أن الدراسة تعتمد على التأصيل النظري، وعرض المعلــــــــــــــــــــــومات والحقائق، بناءا على الكتب والنصوص التشريعية. وتوصلت الدراسة إلى أن تعدد أشكال الرقابة القبلية على الصفقات العمومية بشقيها الداخلي والخارجي هو احترام للإجراءات الإدارية، وضمان للشفافيــــــــة، وحماية للمال العام. Abstract: This ressac study aims to présent the various forms of control over public deals: internal control (a permanent committee for opening envelopes and évaluations offers), external control (committees of deals), This oversight is of paramount importance as long as it is carried out in accordance with the law, respecting the terms of competition and equal opportunities in accessing public requests. The analytical descriptive approach has been adopted to suit the subject; especially the study depends on theoretical rooting, presentation of information and facts. The study found that the plurality of tribal control over public transactions, both internal and external is respect for administrative procedures, a guarantee of transparency and the protection of public funds
