دور النيابة العامة أثناء مرحلتي التحري والتحقيق القضائي

Abstract

يتمحور موضوع دراستنا حول دور النيابة العامة خلال مرحلتي التحري و التحقيق القضائي. بحيث تبين لنا من خلال هذه الدراسة أن المشرع منح سلطة واسعة للنيابة العامة و ذلك بتدخلها في كل إجراء يقوم به رجال الضبطية و رجال القضاء ، و هذا يفقد جانب كبير من فعالية مبدأ الفصل بين السلطات (الاتهام، البحث، التحقيق) و بالرغم من هذا هناك تعاون بين كل من هذه السلطات. يتمثل دور النيابة العامة في قانون الإجراءات الجزائية في توجيه الاتهام لمرتكبي الجرائم نيابة عن المجتمع قصد إنزال العقاب في حقهم، و من ثم فهي خصم في الدعوى العمومية. كما لها دور في إدارة سلطة الدولة في العقاب في مواجهة المتهم. الكلمات المفتاحية: النيابة العامة ، التحري ، التحقيق ، سلطة ، الدعوى العمومية. Abstract : The subject of our study revoles around the role of the puplic prosecution during the investigative and judicial investigation stages, so that it became clear to us through this study that the legislator granted broad authority to the puplic prosecution through its intervention in every action taken by police officers and judicial officers , and this loses a large part of the effectiveness of the principle of separation the authorities(accusation , investigation , investigastin) and we find cooperation between these last. The role of the puplic prosecution in the code of criminal procedure is to charge perpetrators of crimes on behalfd of society with the aim of inflicting punishment on them, and therefore it is an adversary in the puplic lawsuit.
